Modafinil in the UK is a legal, licensed medicine, but only when a qualified prescriber has prescribed it for you. It is a prescription-only medicine (POM), so it is not sold over the counter. It is not listed as a controlled drug, but selling or supplying it without a prescription is a criminal offence.
Key facts
- What it is: A wakefulness-promoting medicine.

- Legal status: Prescription-only medicine (POM). Not listed as a controlled drug under the Misuse of Drugs Act 1971.

- Last checked: October 2026
This guide explains the law on modafinil in the UK in plain English. It covers its legal category, whether it is a controlled substance, the penalties for illegal supply and how to check that a pharmacy is genuine. For a full overview of the medicine, read our complete guide to modafinil.
Is modafinil legal in the UK?
Yes, when it is prescribed for you. The UK Summary of Product Characteristics (SmPC) for modafinil 100 mg tablets lists its legal category as “Prescription only medicine”. That means a doctor or another qualified prescriber must decide it is right for you.
The rules come from the Human Medicines Regulations 2012, regulation 214. It says a prescription only medicine may not be sold or supplied except in line with a prescription from an “appropriate practitioner”.
So modafinil itself is not illegal. What the law controls is how it reaches you: through a valid prescription and a registered pharmacy.
Is modafinil a controlled substance in the UK?
No. Modafinil does not appear on the Home Office’s list of the most commonly encountered controlled drugs (checked October 2026). Its SmPC also lists it as POM only, with no controlled-drug schedule.
The Home Office notes that its list is not exhaustive, so the SmPC legal category is the best place to confirm a medicine’s status. This makes modafinil different from several other medicines people often compare it with:
| Medicine | Legal category | Controlled drug class / schedule |
|---|---|---|
| Modafinil | Prescription-only medicine | Not listed |
| Methylphenidate | Prescription-only medicine | Class B |
| Zopiclone | Prescription-only medicine | Class C, Schedule 4 Part 1 |
| Tapentadol | Prescription-only medicine | Class A, Schedule 2 |
Controlled drugs have extra rules on prescriptions, storage and travel. Our guide to controlled drugs in the UK explains classes and schedules in more detail.
What the law says about selling or supplying modafinil
The Medicines and Healthcare products Regulatory Agency (MHRA) is clear. In its 2016 warning to new university students, it said it is a criminal offence to supply prescription only medicines without a valid prescription. It added that websites offering them are acting illegally.
This applies to anyone who sells or passes on modafinil without a prescription. That includes websites, social media sellers and people sharing their own supply with friends.
What are the penalties?
Breaking regulation 214 is an offence under regulation 255 of the Human Medicines Regulations 2012. The same applies to having a prescription only medicine with intent to supply it without a prescription.
- In a magistrates’ court: a fine.
- In a Crown Court: a fine, up to two years in prison, or both.
Can you get modafinil over the counter?
No. Over-the-counter medicines can be sold by a pharmacy with no prescription, but modafinil is a POM. A pharmacist cannot sell it to you across the counter, and it is not on general sale in shops.
Regulation 214 lists who counts as an appropriate practitioner. They include doctors, dentists, supplementary prescribers and nurse or pharmacist independent prescribers. In practice, the NHS says a GP or specialist may prescribe a stimulant such as modafinil, pitolisant or solriamfetol for narcolepsy.
Any website or seller that supplies modafinil with no prescription is not following UK law.
What modafinil is licensed for in the UK
The SmPC says modafinil is indicated in adults for excessive sleepiness associated with narcolepsy, with or without cataplexy. That is its only licensed use in the UK.
It is not licensed for studying, exams, shift work or general tiredness. The MHRA’s 2016 warning described the misuse of medicines like modafinil by students. It said possible side effects of so-called “cognitive enhancers” include a risk of dependence, heart problems and psychosis.
The NHS also says people taking modafinil need regular checks because it is linked to irregular heartbeats and raised blood pressure, as our guide to modafinil, blood pressure and heart safety explains. It should not be taken in pregnancy, as our guide to modafinil and pregnancy explains. Our guide to modafinil side effects covers these risks in full.
Illegal online sellers and fake medicines
The MHRA regularly takes action against illegal online supply. Some of its operations have involved narcolepsy medicines like modafinil:
- Operation Pangea (2016): the MHRA’s freshers warning said it had seized more than 31,000 doses of narcolepsy medication.
- Operation Pangea (2025): between December 2024 and May 2025, the MHRA seized 7.7 million doses of illegal medicines. It also removed 367 websites and social media accounts. The press release named painkillers, antidepressants and sleeping pills; it did not single out modafinil.
- Operation Lamborghini (2026): in July 2026, four people were sentenced to nearly 15 years combined after an MHRA investigation into illegal online supply. The case involved almost two million doses of medicines such as zopiclone and diazepam, not modafinil, but it shows how seriously courts treat illegal supply.
The MHRA warns that medicines from unverified sources come with no guarantee that they are safe or effective. Some contain dangerous or illegal ingredients.
How to check a pharmacy is genuine
In Great Britain, pharmacies, pharmacists and pharmacy technicians are registered with the General Pharmaceutical Council (GPhC). You can check their details and registration status on the GPhC online registers.
- Choose the register: pharmacy, pharmacist or pharmacy technician.
- Search by name, registration number, or town or postcode.
- Check the details match the website or shop you are using.
A genuine service will always ask for a prescription or carry out a proper clinical assessment by a prescriber. Our step-by-step guide on how to check a UK online pharmacy covers the warning signs to look for.
Travelling with modafinil
The GOV.UK guidance on taking medicine in or out of the UK mainly covers controlled drugs. It says a doctor or pharmacist can tell you whether your medicine contains one. As modafinil is not listed as a controlled drug, those UK controlled-drug rules do not usually apply to it.
Other countries set their own rules, which may be stricter. Before you travel, check the rules of the country you are visiting. Keep modafinil in its original pack with your prescription or a letter from your prescriber.
When to get help
Call 999 or go to A&E if you or someone else has taken modafinil and has chest pain, a very fast or irregular heartbeat, a seizure, severe confusion, or a serious skin reaction with blistering or peeling.
Call NHS 111 or speak to your prescriber if you notice changes in your mood, anxiety, sleep problems or a rash while taking it. Do not take modafinil that was not prescribed for you.
If you think you have had a side effect, or were sold a medicine that might be fake, you can report it through the MHRA Yellow Card scheme.
